This policy defines the protection principles applicable to molds, technical drawings, product development materials, OEM projects, private label programs, know-how, samples and manufacturing-related confidential information.
PhoenixPack treats its molds, manufacturing methods, product structures, technical files, production data, samples, designs, specifications and OEM development processes as protected industrial know-how and confidential commercial assets.
The following materials and information are protected and may not be copied, disclosed, reproduced, reverse engineered or used without prior written authorization:
Unless otherwise agreed in a signed written contract, molds developed, owned, purchased, modified, repaired or operated by PhoenixPack remain under the ownership, control or operational authority of PhoenixPack.
Payment of mold-related costs by a customer does not automatically grant ownership, unrestricted usage rights, transfer rights or the right to remove the mold from PhoenixPack facilities unless expressly agreed in writing.
OEM, private label and customer-specific projects may involve sensitive commercial and technical information. Both parties are expected to protect product details, pricing, supply structures, samples, drawings and project-related communications as confidential information.
No party may use PhoenixPack’s molds, samples, documents, product structures, drawings, technical information, photographs, catalogues, production methods or project details to develop, manufacture, source, copy or commission similar products without written authorization.
Samples, prototypes or trial products are provided only for evaluation purposes. They may not be copied, reverse engineered, commercially reproduced, sold, distributed or used for third-party manufacturing unless PhoenixPack gives written permission.
Technical documents, product sheets, specification files, catalogues, drawings and digital materials provided by PhoenixPack are shared for commercial evaluation or approved operational use only. They do not transfer intellectual property rights or manufacturing rights.
If a customer provides its own drawings, brand materials or product design, the customer represents that it has the legal right to use and submit such materials. PhoenixPack shall not be responsible for third-party intellectual property claims arising from customer-supplied materials.
Unauthorized copying, disclosure, reverse engineering, use or transfer of protected materials may result in suspension of cooperation, cancellation of supply, claims for damages, injunctive relief and other legal remedies available under applicable law.
If a specific OEM agreement, mold agreement, confidentiality agreement, private label agreement or supply contract contains more detailed provisions, that document shall prevail over this general policy.
